Interpretation and Definitions

Interpretation

The words with initial capital letters have meanings defined under the following conditions. The following definitions shall have the same meaning regardless of whether they appear in singular or plural.

Definitions

For the purposes of this Return and Refund Policy:

  • Company (referred to as either “the Company”, “We”, “Us” or “Our”) refers to Flippy, operated by SHAY GROUP FZE LLC.
  • Goods refers to the toys, games, books, essentials, and related items provided to You under a Flippy Membership, order, or purchase.
  • Orders means a request by You to access, rent, or purchase Goods from Us.
  • Service refers to the Website and membership platform.
  • Website refers to Flippy, accessible from https://flippyworld.com/.
  • Membership means the subscription plan purchased by You which provides Tokens to access and use Flippy’s library of Goods.
  • Tokens means the digital credits allocated under Your Membership that represent the borrowing value of Goods. Tokens are released when Goods are Returned and can then be reused for new Picks.
  • Pick means the process by which You select Goods from the Flippy library using available Tokens.
  • Play means the rental and use of Goods by You during the active period of Your Membership.
  • Swap means the act of Returning one or more Goods and using the released Tokens to Pick new Goods.
  • Return means the process of sending Goods back to Flippy, either for a Swap, Membership cancellation (where permitted), or at the end of use.
  • You means the individual accessing or using the Service, or the company, or other legal entity on behalf of which such individual is accessing or using the Service.

Your Order Cancellation Rights

You may cancel Your Membership within 10 days of signing up, provided no Goods have been ordered using Tokens.

To exercise Your right of cancellation, You must inform Us clearly by:

We will confirm receipt of your request and guide You through the process. Where eligible, refunds will be processed within 14 days of request. Refunds will be issued using the same method of payment You used for the Order unless otherwise agreed.

Important: Once Goods are ordered or delivered using Your Tokens, You may not cancel Your Membership. Instead, You can continue enjoying Your plan by using Tokens to Pick, Play & Swap in line with your Membership terms, or Return Goods under the conditions set out below.

Conditions for Returns

For Goods to be eligible for a Return or Swap, please ensure that:

  • Goods are returned with all parts, accessories, and original packaging (including Flippy bags, pouches, and manuals). A part list for each Good is available on Your Dashboard and provided with the order for ease of upkeep.

  • The best scenario is to Return Goods in clean, undamaged, and in substantially the same condition as received, allowing for normal handling.

Under this condition, the same number of Tokens used for Renting the product will be returned to Your account once the Return has been approved. If any concerns are identified this will be communicated to You via the agreed communication channel, and the following conditions will apply:

We understand that sometimes:

  • Goods can get dirty — We will take care of routine cleaning.

  • Part of Goods are missed to be returned and are securely available with You — In this case You will be responsible for covering the charges to Return this product or part of product to the Company. Until the product is fully returned, Tokens of the product will remain reserved. 

  • Goods may be partially or fully damaged, broken, or have missing parts — In such cases, the part list pricing available on Your Dashboard will be used to assess fair compensation charges.

  • Goods are fully broken — We will assess a fair replacement cost or place a hold on Tokens until an agreement is reached. Tokens will remain reserved until You confirm the resolution.

We reserve the right to inspect and adjust compensation fairly based on the above conditions.

We also reserve the right to refuse Returns of any Goods that do not meet the above return conditions in our sole discretion.

Returning Goods

The Company will cover the cost of returning the Goods back to Us, unless the Return is due to the conditions mentioned above, in which case You will be responsible for covering the Return costs to the below address using a courier service with tracking.  

For Goods shipped to Us by You, we cannot be held responsible for Goods damaged or lost in return shipment. Therefore, We recommend an insured and trackable mail service.

Gifts

If the Goods were marked as a gift then they are Yours to keep for lifetime, and we do not expect them to be Returned. 

How to identify these- 

  • Gifts will have a “this is a gift for you” label 
  • Gifts will not have a part list provided with the order or on Your Dashboard.
  • Gifts will not be shown on Your Dashboard as a Good that can be Returned.
  • Gifts include freebies, giveaway wins and marketing brochures.
